Monday May 5, 2003 will go down in history as a day to remember in employment law. It was the day the long-debated amendments to the Health Safety in Employment Act finally came into effect. Why is this new legislation so important? The term “workplace stress” took on a whole new significance, with new obligations for employers, and potentially serious financial consequences for those who ignore them. Workplace stress is no longer simply a sad fact of life. It is now an officially recognised and legislated “workplace hazard”, with the amendments extending the definitions of “harm” and “hazard” to include physical and mental harm caused by work-related stress. A cursory reading of the new legislation might be enough to instantly treble employers workplace stress, but a deeper understanding goes some way to restoring mental equilibrium. The Occupational Safety and Health booklet, Healthy work, Managing Stress in the Workplace, tells employers that “there is only a requirement to manage work stressors or the individuals stressed situation where you can be reasonably expected to know about the stress. Even then the obligation is only to do what is reasonably practicable in the circumstances.”

WASHINGTON - The U.S. Fish and Wildlife Service is proposing the creation of new regulations that expand the hunting of Canada geese in hopes of reducing the current resident population of 3.5 million by 1.2 million. As a result, the agency wants to allow states to undertake approved population control strategies, such as nest and egg destruction, trapping and culling programs and expanded hunting opportunities. “The service believes that the problems caused by resident Canada geese can be best addressed at the state level,” said agency director Steve Williams. “To that end, we are committed to providing state wildlife management agencies with as much flexibility as possible to address the issue.”

The giddiness and glee over heroin in Please Kill Me is replaced by a sense of small-time tragedy in But Beautiful, because the book takes place where both the pleasure and the pain are, because the book can orchestrate silence as well as noise. Writing on Chet Baker - once the ingenue of jazz, then its lizard-faced junkie poster boy - Dyer, seeking that place where all art begins, can make a complete fool of himself: He could only play with such tenderness because hed never known real tenderness in his life. And Dyer can get to places few writers on music know exist - He was the opposite of his friend Art, who put everything of himself into everything he played: Chet put nothing of himself into his music and thats what lent his playing his pathos. The music he played felt abandoned by him.His friend Art - Id read that passage four times before I caught the pun, which Dyer may never have placed there. But the book is so driven by its need to get close to the art that sparked it you can find the like of that phrase all across it, hidden on any given page. Here there is no scene, only a music that begins in solipsism and refuses it. In Please Kill Me there is not even isolation, at least until the last pages. And yet all you had to do to prove that there is an irreducible music at the core of the book that denies the reality of inner lives was to catch Nikes Search and Destroy commercial during the Olympics: a montage of violent sports images running over a twenty-three-year-old Stooges song that the world outside of the one Please Kill Me describes hasnt begun to catch up with.

As H.R. 975, the “Bankruptcy Abuse Prevention and Consumer Protection Act of 2003″ (the Act), inches toward almost inevitable enactment, two questions are on the minds of many bankruptcy professionals. First, why single out consumer debtors and not all individuals for “special” treatment? After all, the big money is not with the consumer debtor, but rather with individuals whose debts are not primarily consumer. In addition, the Act will no doubt spawn additional litigation over the definition of a “consumer debt” and whether the debtor has “primarily consumer debts.” Just as important, though, is the question of whether its enactment will result in a large-scale exodus from the ranks of those who now represent consumer debtors. I cannot answer the first question, but as to the second, I am among the pessimistic: It is highly likely there will be a substantial number of consumer bankruptcy practitioners who will opt out. The complex and convoluted, as well as internally inconsistent provisions of the Act provide significant cause for concern. There is a fear among many on the bench that the more experienced practitioners will no longer represent consumer debtors. As one bankruptcy judge remarked to me, he fears that the more careful practitioners will bail out, leaving the courts to deal with the sloppy practitioners and an even larger number of pro se debtors. This will create a domino effect, with bankruptcy judges either taking early retirement or leaving the bench before retirement age. Replacements for those bankruptcy judges who leave the bench will also be drawn from a smaller and, unfortunately, more than likely less-qualified, pool because those who are experienced and knowledgeable will decline to serve for the same reason that those who are serving leave. What is in the Act that will have so many experienced consumer debtor practitioners literally quaking in their boots? There are several provisions-some of minor consequence, and some that should make every consumer debtors counsel shudder. This article looks at some of those provisions that directly affect practitioners who represent consumer debtors and the impact that each may have. (Unless otherwise indicated, references in this article to Code sections are to the Bankruptcy Code, Title 11, as amended by the Act.)

That is a particular sorrow to me, because the cowboy hat is a hat of unusual eloquence. No hat — except maybe a bishops miter — expresses such earned authority, and no other hat connotes the high plains and the smell of sagebrush and a life lived with lonely integrity. The cowboy hats history goes back to the 1860s, when its form was standardized by John B. Stetsons Boss of the Plains model. Since then it has cast a ten-gallon shadow across the West and the world. Up in Billings, Montana, Ritch Rand wears a cowboy hat the way Cal Ripken, Jr., wears an Orioles uniform. Thats a good thing, because Rand is one of the Wests premier custom cowboy hatters, his Billings store a temple to the pencil-rolled brim, the cattlemans crease, and fur felt macerated into something approaching art. “We do about 500 hats a month,” Rand says. He talks down to me: at 6 feet 8 inches, he talks down to almost everyone. A man accused of causing a fatal accident on the Bangerter Highway last April pleaded guilty Tuesday to one count of automobile homicide. Finhas Habib, 37, appeared in 3rd District Court to enter his plea to the second-degree felony. Police reported Habib ran a red light and hit a pickup truck, knocking it off the road and into a ditch. The trucks driver, Chad L. Hayward, was killed, and two passengers in Habibs car were injured.

Two auto-pedestrian accidents, one of them fatal, were among a spate of weather-related crashes Friday evening. Midvale Police Sgt. Ken Jarvis said an 89-year-old woman whose house is on the southwest corner of the intersection of 7720 South and 310 West was returning from the store just before 6 p.m. when she was hit, probably while in the crosswalk. Myles won a $1.9 million lawsuit against Sapta in connection with a failed business deal involving OSO Motors Inc., formerly owned by Sapta. Plaintiffs allege they conducted extensive investigation for Brown to assist him in representing Myles. They also say that Brown made assurances to them that they would be paid “well in excess of their normal hourly rate” for the work. Berglan and Taylor contend they devoted nine investigators and hundreds of man hours to help Brown but have not received payment for the work. They also allege that they turned over their files on the case to Brown as part of a settlement Myles was to reach with Sapta that never materialized. Part of the failed settlement required all records in the case to be destroyed. Though the records are still intact, plaintiffs say that Brown wont give them up. “I dont know why hes keeping my files,” Taylor said. A similar plea was made by Myles new attorney, Russell Wright, who claims that Brown is unlawfully holding Myles file and preventing Wright, a former associate of Brown, from adequately representing Myles. Myles terminated Brown as his attorney in April. He has been unable to collect any of his $1.9 million judgment from Sapta. Brown argues that he is entitled to keep Myles file as a lien on his portion of the judgment Myles received. Earlier this week, federal Judge Robin Cauthron refused to consider Wrights motion to compel Brown to turn over Myles file. This current law suit, says Brown, is an indirect attempt by Wright, who offices with Taylor, to obtain Myles file. Brown said Berglan and Taylors case is without merit. “The case will be resolved swiftly,” he said.

I am talking about the chronic givers–elderly people and those who are doctor dependent. One woman has kept me in eight varieties of home made jam for years. To her I give excess produce from my garden (whether it is suitable for incorporation in jam or not). Patients who insist on bringing chocolate for my children on ever), visit receive some sort of confectionery from them at Christmas. You may argue that by this reciprocity I am perpetuating the situation. I feel it restores a balance. Some patients do not like it, which is fine by me. If they refuse to accept a gift from me how could I possibly take one from them? At this point I have to admit that I was brought up giving presents to patients. I clearly remember, as a child in the 60s, doing the Christmas round with my father, who was also a general practitioner. The back of his car contained a large cardboard box of poinsettias and half a dozen individually wrapped baby bottles of champagne. As darkness fell and Christmas lights came on in windows we would drive from one fusty home to another, greeting impossibly old and decaying and undoubtedly lonely people. Everywhere the welcome was warm; sometimes there were drinks and mince pies, and we collected chocolates and bottles ourselves as the afternoon progressed. These patients had become special to my father over the years by virtue of their age, their disabilities, their social isolation, or just their personalities. Moreover, I suspect that giving as well as receiving at Christmas helped him to maintain a position of strength through the ensuing 12 months of regular visiting, a feature of general practice in those days.

What made the difference was aloof frontwoman Victoria Bergsman, who last year dramatically left the band hours before an appearance on the Jonathan Ross show. This in the wake of a traumatic trip to the States, where she collapsed on a New York stage and the band had their equipment nicked in Boston. The Concretes have recruited a new singer from within their own ranks- drummer Lisa Millberg. Taking just the bands nervy start, Millberg seems to be a mistake. The gangly blondes awful melodic aim makes you fear for the lights. You only snatch at rare moments where she finds a delicate sigh that matches the tenderness of certain songs. Uncomfortable at the front of the stage, Millberg continually seeks reassurance from colleagues, especially guitarist Maria Eriksson, with whom she shares some wayward call and responses. Yet Millberg connects with the crowd, not only through vulnerability, but also with a playful banter unknown in previous shows. She points out that this is the 11th time the outfit have performed in London and adds that “the venues keep getting smaller”. Such is The Concretes plight that the vocalist introduces “Oh Boy” with an urge to vote for their forthcoming single on digital station BBC6. This is one of the few numbers close to matching the band in their pomp.

ONE of the cooks who had the greatest influence on me in my girlhood was not a cook at all, or even a real person. She was Lady Addle, that wonderful fictional character of the Forties, a distressed noblewoman struggling against the austerities of the Home Front in the second world war, whose exploits I discovered on the bookshelves at home. I feel rather like Lady Addle about salmon. Salmon, as she might have said, is not what it was. Once an expensive delicacy, it has now, like chicken, become flavourless, factory-farmed fast food. Yet supermarket salmon is an essential staple food; it is cheap, nutritious, neatly packaged in fillets and steaks and is on every list of the ten healthiest things you can eat, along with broccoli, brazil nuts and dried Hunza apricots. So, the domestic cook must bring the resolution of a Lady Addle to those sad, artificially orange little bits of fish. My favourite method is to cook salmon fillets, individually wrapped in foil, for about 15 or 20 minutes in an oven heated to about 180C. It is quicker to roast them uncovered in a hot oven for about 8-10 minutes or to grill them on a hot metal sheet or Le Creuset (or similar) dish for 6-7 minutes. But baking in foil is the simplest method, the least smelly and the least likely to make the salmon dry. I think the fish actually improves by waiting for a while in its foil parcels, if you take it out when still slightly underdone. This leaves plenty of time to do something about the rest of supper and even about some sort of sauce - always the problem for the hard-pressed domestic cook, who has no time for serious sauces.

Abstract Despite the large amount of research that has been devoted to analyzing the determinants of residential real estate agent income, little attention has been directed at how this income is generated.1 Numerous papers (e.g., Follain, Lutes, and Meier, 1987; Glower and Hendershott (1988); and Crellin, Frew, and Jud, 1988) have found that education, experience, firm size, and hours worked have a positive impact on agent income. Abelson, Kacmar, and Jackofsky (1990), Sirmans and Swicegood (1997), and Simians and Swicegood (2000) also found a positive relationship between non-pecuniary factors such as job satisfaction and agent performance. These studies assume, if only implicitly, that salespeople are indifferent as to the way this income is produced, whether from their own listings or from the sale of other agents listings. This, in fact, may not be the case. Certain agent activities may well have greater income producing potential than other types of actions. If this conjecture is true, then specialization in those types of activities would provide the greatest potential for income production. For example, effort spent in generating property listings may prove more productive than the same amount of effort spent trying to market these properties to buyers. Agents are not all created equal; those salespeople who have the talent or skill set that makes them more effective at listing and selling property may also earn more than agents specializing in sales of property to buyers or vice versa. Alternatively, a balanced output of listings and sales may prove more revenue enhancing given current industry commission sharing arrangements. It is also possible that agents and firms, while both seeking to maximize their gains, do so in a different manner. The purpose of this research is to examine whether or not specializing in one side of the real estate transaction or producing a more balanced production portfolio of both listings and sales has a differential impact on agent income.

One of the most significant avenues of vulnerability in this area is the household trash. A person may receive an unsolicited credit card offer and, dismissing it as junk mail, throw it away. Builders rushed to break ground on new projects to meet strong demand fueled by low mortgage rates. While the May increase was slightly below the 0.6 percent gain that had been forecast, economists blamed a decline in the South on the temporary effect of unusually wet weather in Florida and other parts of the South. They noted that permits for new construction, a key indicator of future strength, came in at a solid annual rate of 2.050 million units. “We still have a red-hot housing market,” said David Seiders, chief economist of the National Association of Home Builders. “Surveys of both lenders and builders are showing tremendous ongoing strength with little or no hints that anything is starting to fall.”
Rebounding from a B-month low, total housing starts surged 5 percent, up from 1.54 million units in April to 1.96 million in May. Single-family starts were up 2.1 percent in May as well. The National Association of Home Builders reported increases in new home and apartment construction in May for three regions: West, up 15.8 percent; South, 8.5 percent; and Northeast, 1.7 percent.

The books rich vocabulary, lively first-person narrative and realistic details, such as the murder of the neighbors sickly baby, will hold the readers rapt attention. In the Yukon Public Schools board room, gifted students watched with wonder as authentic 19th century Cheyenne moccasins were presented to show how they reflected Native American trade. “The beads used in making these moccasins were manufactured in glass factories of northern Italy and Bohemia,” said Curator Jeff Briley of the Oklahoma Historical Society. “Through an intricate trading system, these beads came to the Great Plains of North America and were traded to Indians for hides and furs.” This amounted to a “field trip” for the students, but they stayed in Yukon while Briley and Byers demonstrated the trade significance and care of artifacts from the State Museum of History near the State Capitol.

Out for views, up for light: those are the directions this tall, four-sided bay takes to gain garden views. Since the shallow pitch of the existing roof would have cramped the high, open greenhouse look the Starrs wanted, designer Linda Thornton of Carmel, California, gave the bay an octagonal roof of its own. It rises almost 3 feet above the existing roof, radiating from a central point above the eave line. Half of it notches into the old roof; the other half extends beyond to top the four glass walls. Only three support posts obstruct garden views through the glass panes. Outside, a planter wraps around the base of the bay, softening the expanse of concrete patio.
